Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of the "Tracify - Drawing" application ("App" or "Service"). By downloading, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use the Service.

We may amend these Terms at our discretion at any time by posting the amended Terms within the App's Settings menu. You will be deemed to have accepted such amendments by continuing to use the Service.

2. License and Intellectual Property

• Ownership: Tracify owns, has licensed, or otherwise has the right to use all of the pre-defined content that appears in the Service, including but not limited to the sketch categories (e.g., Animals, Dinosaurs, Manga, Princesses) and the application's interface, design, and source code. You acknowledge that you have no ownership rights in the App's native content.
• Limited License: We hereby grant you a non-exclusive, non-transferable, and revocable limited license to use the Service for your personal, non-commercial entertainment and educational use.
• User-Generated Content: You retain all ownership rights to the physical drawings you create using the App and the original photos you import from your device's Gallery.

3. User Content and AI Features

• Your Representations: By importing photos into the App (e.g., to use the "Create with AI" feature), you represent and warrant that you own the rights to those images and that processing them does not violate any applicable laws or third-party rights.
• License to Process: You grant us a temporary license to process your uploaded images strictly for the purpose of operating the Service, such as generating AI sketch templates.
• Feedback and Discord: If you submit suggestions, ideas, or feedback via our Discord integration ("Suggest improvements"), you grant us a worldwide, perpetual, royalty-free license to use, implement, and adapt your feedback without any obligation or compensation to you.

4. Fees, Subscriptions, and Advertising

• Free Version and Ads: The base version of Tracify is provided free of charge and is supported by third-party advertising ("Ad spaces"). By using the free version, you consent to the display of these advertisements.
• Premium Subscriptions: We offer a "Premium" subscription (available on Weekly and Monthly plans) that unlocks all features, including over 500 sketches, exclusive templates, AI photo-to-sketch transformation, and an ad-free experience.
• Billing and Refunds: All fees are processed entirely through your device's respective app marketplace (e.g., Google Play Store or Apple App Store). Subscription renewals, cancellations, and refund requests are governed exclusively by the terms of the applicable app marketplace. You agree and acknowledge that Tracify is not required to provide a refund directly for any reason.

5. Your Responsibilities in Using the Service

While using Tracify, you agree not to:

• Use the Service to process, upload, or generate any material that is illegal, abusive, threatening, obscene, defamatory, or infringes on third-party intellectual property rights.
• Attempt to reverse engineer, decompile, or otherwise derive the source code or underlying AI models of the App.
• Interfere with or disable any security-related features of the Service.
• Make improper use of our support services or Discord channels, including spamming or submitting false reports.
• Use the App in any way that violates applicable local, national, or international laws.

6. Disclaimers and Limitations of Liability

• Disclaimer of Warranties: You expressly acknowledge and agree that use of the Service is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. We do not warrant that the Service will be uninterrupted, error-free, or entirely accurate (particularly regarding AI-generated sketch conversions).
• Physical Damage Disclaimer: Tracify includes features that require you to position your device over paper (e.g., "Dessiner avec la caméra / 2 Steps") using external supports like a glass. You are solely responsible for securing your device. We are not liable for any physical damage to your mobile device resulting from falls, spills, or accidents while using the App.
• Limitation of Liability: To the fullest extent permitted by law, the developers of Tracify shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Service.

7. Third-Party Services

The App may contain links to third-party services, including Discord for community feedback and various advertising networks. Any interactions, charges, or obligations you incur in your dealings with these third parties are your sole responsibility. We make no representations regarding third-party content and are not responsible for their privacy policies or practices.

8. Suspension and Termination

We reserve the right to limit, suspend, or terminate your access to the Service at any time, permanently or temporarily, without prior notice, if you violate these Terms or engage in illegal or harmful conduct.

9. General Provisions

• Governing Law: These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the Province of Québec, Canada, without regard to its conflict of law provisions. Any legal action or proceeding related to the App shall be brought exclusively in the courts located in Québec.
• Entire Agreement: These Terms, alongside our Privacy Policy, constitute the complete and exclusive understanding relating to your use of the Service.
• Force Majeure: We will not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including network failures, cyber-attacks, or acts of God.
